REGULATIONS OF AQUA SPEED ONLINE STORE

 

    1. Definitions


    The terms used in the Regulations shall mean:
        1.1 Customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order within the Store;
        1.2 Consumer - a customer who is a natural person and meets the criteria set out in the definition of Article. 22[1] of the Civil Code. According to this definition a Consumer is a natural person making a legal transaction with an entrepreneur that is not directly related to his/her business or occupation.
        1.3 Civil Code - Act of April 23, 1964. (Journal of Laws No. 16, item 93 as amended);
        1.4 Regulations - these Regulations governing the provision of services electronically within the Aqua Speed online store;
        1.5 Internet Store (Store) - internet service available at aquaspeed.com.pl, through which the Client may in particular place Orders;
        1.6 Goods - products presented in the Online Store;
        1.7 Sales agreement - agreement for the sale of Goods, as defined by the Civil Code, concluded between PPHU SPORTEX, Grzegorz Bielecki and the Client, concluded with the use of the Internet website of the Store;
        1.8 Act on consumer rights - Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
        1.9 Act on provision of services by electronic means - Act of 18 July 2002 on provision of services by electronic means (Journal of Laws No. 144, item 1204 as amended);
        1.10 Order - Customer's declaration of will that aims directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.

 
    2. General provisions


        2.1 These Rules define the principles of use of the Internet store available at aquaspeed.com.pl and are the rules referred to in Article 8 of the Act on Provision of Electronic Services.
        2.2 The Internet store, operating under the address: aquaspeed.com.pl, is run by PPHU SPORTEX, Grzegorz Bielecki.
        2.3 These Regulations define, in particular:
            2.3.1 principles of registration and account use within the Internet store;
            2.3.2 Terms and conditions for electronic reservation of products available in the online store;
            2.3.3 conditions and principles of placing electronic Orders within the framework of the internet store;
            2.3.4 principles of concluding Sales Agreements with the use of services provided by the online store.
        2.4 The use of the online store is possible on condition that the ICT system used by the Client meets the following minimum technical requirements:
            2.4.1 Chrome version 31 or higher with JavaScript enabled,
            2.4.2 Mozilla Firefox version 31 or higher with JavaScript enabled,
            2.4.3 MS Internet Explorer version 11 or later with JavaScript enabled,
            2.4.4 MS Edge version 12 or later with JavaScript enabled,
            2.4.5 Opera version 31 or later with JavaScript enabled,
            2.4.6 Safari version 8 or later with JavaScript enabled,
            2.4.7 minimum screen resolution of 1024 x 768 pixels.
       2.5 In accordance with the applicable laws, SPORTEX Grzegorz Bielecki reserves the right to limit the provision of services through the Internet Shop to persons over 18 years of age. In such a case, potential customers will be informed about the above.
       2.6 The Customers may access these Regulations at any time through the link placed on the main page of the aquaspeed.com.pl website, as well as save its content and make a printout.

    3. Rules of using the Internet Shop

    3.1 In order to ensure the security of the transmission of messages and data in connection with the services provided as part of the Website, the Internet Shop takes technical and organisational measures appropriate to the degree of risk to the security of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data sent on the Internet.

    3.2 The customer is obliged to:

         3.2.1 not to provide or transmit content that is prohibited by law, e.g. content that promotes violence, slanderous or violating personal rights and other rights of third parties,

         3.2.2 use the online store in a manner that does not interfere with its functioning, in particular by using specific software or devices,

         3.2.3 use the Internet store in a manner compliant with the provisions of the law in force in the Republic of Poland, with the provisions of the Terms and Conditions and with the general Internet usage rules.

 

4. Procedure for conclusion of the Sales Agreement

    4.1 Information about the Goods given on the websites of the Store, in particular their descriptions, technical and usable parameters as well as prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.

    4.2 In order to conclude a Sales agreement via the Internet Store, it is necessary to enter the website aquaspeed.com.pl, make a choice of goods, taking further technical actions on the basis of messages displayed to the Client and information available on the website.

    4.3 The Goods ordered by the Client are selected by adding them to the shopping cart.

    4.4 In the course of submitting the Order - until the moment of clicking the button "Order with obligation to pay" - The Customer has the possibility to modify the entered data and the selected Goods. For this purpose, the messages displayed to the Customer and the information available on the website shall be followed.

    4.5 After the Customer using the online store has provided all the necessary data, a summary of the placed order shall be displayed. The order summary shall include information on:

        4.5.1 the subject of the order,

        4.5.2 unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

        4.5.3 the selected payment method,

        4.5.4 the selected method of delivery,

        4.5.5 delivery time,

    4.6 In order to send the Order it is necessary to provide personal data marked as obligatory and press the button "Order with obligation to pay".

    4.7 Sending an Order by the Customer is a statement of will to conclude a Sales Agreement with PPHU SPORTEX, Grzegorz Bielecki, in accordance with the content of the Regulations.

    4.8 After placing the Order, the Customer receives an e-mail message entitled "You have placed an order no. (...)", containing a final confirmation of all significant elements of the Order

    4.9 The contract is considered concluded at the moment of receiving by the Customer the e-mail mentioned above.

    4.10 The Agreement is concluded in the Polish language. Recording, securing and making available the data of the Order and the general conditions (Regulations of the online store) takes place via e-mail.

 

5. Delivery of

    5.1 Delivery of the Goods is limited to the territory of the Republic of Poland and takes place to the address specified by the Client in the course of placing the Order.

    5.2 Delivery of the ordered Goods is carried out by courier DPD or InPost. Delivery costs shall be indicated at the time of placing the Order.

    5.3 Delivery time is from 1 to 2 working days from the date of sending the Order by the Customer.

 

6. Prices and payment methods

    6.1 Prices of Goods are given in Polish zloty and include all components, including VAT.

    6.2 The Customer has the option to pay the price

        6.2.1 by bank transfer to the bank account number 84 1090 2590 0000 0001 4306 9896,

        6.2.2 payment via IAI Pay,

        6.2.3 by cash or card upon delivery.

 

7. Right of withdrawal

    7.1 The customer who is a consumer has a 14-day period to withdraw from the contract. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the date of receipt of ordered products.

    7.2 To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or e-mail).

    7.3 You may use the model withdrawal form, but it is not obligatory.

    7.4 To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

 

8. Effects of withdrawal

   8.1 If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will reimburse you using the same means of payment as you used in the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees in connection with this reimbursement.

 

9. Complaints concerning Goods

    9.1 PPHU SPORTEX, Grzegorz Bielecki as a seller is liable to the Customer who is a Consumer within the meaning of Article 22[1] of the Civil Code, under warranty for defects within the scope set out in the Civil Code, in particular Article 556 and Articles 556[1] - 556[3] and subsequent Civil Code.

    9.2 Complaints arising from violation of rights guaranteed by law or under these Terms and Conditions should be addressed to sklep@aquaspeed.com.pl. The Seller undertakes to process each complaint within 14 days.

    9.3 PPHU SPORTEX, Grzegorz Bielecki is not a manufacturer of goods. The manufacturer is liable under warranty for the sold Goods under the conditions and for the period specified in the warranty card. If the warranty document provides such a possibility, the Customer may submit his or her claims under the warranty directly to the authorized service center whose address is specified in the warranty card.

 

10. Complaints in the field of electronic services

    10.1 The Internet store undertakes actions in order to ensure fully proper functioning of the service and web pages of the store, to the extent resulting from the current technical knowledge, and undertakes to remove all technical irregularities reported by the Customers within a reasonable time.

    10.2 Irregularities related to the functioning of the service and store websites can be reported by the Customer by e-mail to sklep@aquaspeed.com.pl or by using the contact form.

    10.3 In a complaint, the Customer should describe the type and date of occurrence of irregularities related to the functioning of the Store.

 

11. Dispute resolution and final provisions

    11.1 A Customer who is a Consumer can, if interested, use the out-of-court complaint and claim settlement methods. Online shopping disputes can be resolved through mediation proceedings before the Provincial Inspectorates of Trade Inspection or arbitration proceedings at the Provincial Inspectorate of Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and e.g. file his/her complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/

    11.2 In matters not regulated herein, the provisions of the Civil Code, the provisions of the Act on Rendering Electronic Services and other relevant provisions of Polish law shall apply.
